Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of HoneAI ("the App", "the Service"), operated by HoneAI ("we", "us", "our"). By creating an account or using HoneAI in any way, you agree to be bound by these Terms.

If you do not agree to these Terms, do not download or use HoneAI.

2. Description of Service

HoneAI is an AI-powered freelance business assistant that helps users generate proposals, invoices, and follow-up communications; analyse client emails and messages; track payments; manage client relationships; and obtain AI-generated business insights. HoneAI uses the Anthropic Claude API to power its AI features.

3. Account Registration

To use HoneAI, you must create an account using a valid email address or Sign in with Apple. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activity that occurs under your account
• Notifying us immediately of any unauthorised use at support@honeai.app

You must be at least 18 years old to use HoneAI. By creating an account, you represent that you are 18 or older.

4. Subscriptions and Billing

4.1 Subscription Tiers

HoneAI offers three tiers:

• Free: Up to 3 clients, 15 AI uses per month, limited insights
• Pro ($9.99/month or $79.99/year): Unlimited clients, unlimited AI, full per-client insights, Business Insights preview, custom templates
• Elite ($14.99/month or $119.99/year): Everything in Pro plus full Business Insights

4.2 Billing and Renewal

Subscriptions are billed through the Apple App Store. Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period. You can manage subscriptions and turn off auto-renewal in your App Store Account Settings.

4.3 Free Trial

Where offered, free trials automatically convert to paid subscriptions at the end of the trial period unless cancelled beforehand.

4.4 Refunds

Refund requests are handled by Apple in accordance with their refund policy. HoneAI does not issue refunds directly. To request a refund, visit reportaproblem.apple.com.

4.5 Referral Rewards

The HoneAI referral programme grants free subscription months to users who refer new users. Referral rewards are granted at our discretion and may be modified or discontinued at any time. Free months cannot be exchanged for cash.

5. Acceptable Use

You agree to use HoneAI only for lawful purposes. You must not:

• Use HoneAI to harass, threaten, or defraud any person or entity
• Generate content that is illegal, defamatory, discriminatory, or harmful
• Use HoneAI to send spam, unsolicited communications, or phishing messages
• Attempt to gain unauthorised access to HoneAI's systems or other users' accounts
• Reverse engineer, decompile, or attempt to extract HoneAI's source code or AI prompts
• Use HoneAI to infringe intellectual property rights
• Use automated tools to access HoneAI at a rate that exceeds normal human usage
• Resell or sublicence access to HoneAI

We reserve the right to suspend or terminate accounts that violate these terms.

6. AI-Generated Content

6.1 Nature of AI Outputs

HoneAI uses artificial intelligence to generate content including proposals, invoices, follow-up emails, insights, and analyses. These outputs are generated automatically and:

• Are suggestions only, not professional advice
• May contain inaccuracies, errors, or inappropriate content
• Should be reviewed and edited by you before use
• Do not constitute legal, financial, tax, or business advice

6.2 Your Responsibility

You are solely responsible for reviewing, editing, and deciding whether to use any AI-generated content. By sending any AI-generated communication to a third party, you represent that you have reviewed it and accept responsibility for its content.

6.3 Ownership of Outputs

AI-generated content produced using your input and context is yours to use as you see fit, subject to Anthropic's usage policies.

7. Payment Facilitation

HoneAI facilitates payment requests by generating links, QR codes, and payment information for third-party payment services (Venmo, Cash App, PayPal, Zelle). You acknowledge that:

• HoneAI is not a payment processor and does not handle, hold, or route any funds
• All transactions occur directly between you and your clients through third-party payment services
• HoneAI is not a party to any transaction
• HoneAI accepts no responsibility for payment disputes, failed payments, chargebacks, or any financial losses arising from transactions facilitated through the app
• You are responsible for compliance with all applicable tax and reporting obligations

8. Client Data and Privacy

You are responsible for ensuring that any personal data you enter into HoneAI (including client names, emails, and phone numbers) has been collected lawfully and that you have a legitimate basis for processing it. Our handling of this data is described in our Privacy Policy.

9. Intellectual Property

9.1 HoneAI IP

HoneAI, including its design, code, AI prompts, features, and content, is protected by copyright and other intellectual property laws. You may not copy, reproduce, or distribute any part of HoneAI without our written permission.

9.2 Your Content

You retain ownership of all data and content you enter into HoneAI. By using the AI features, you grant us a limited licence to process your content solely for the purpose of providing the HoneAI service to you.

10. Disclaimers

HoneAI is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that:

• The service will be uninterrupted, error-free, or secure
• AI-generated content will be accurate, complete, or appropriate for your purposes
• The service will meet your specific business requirements

11. Limitation of Liability

To the fullest extent permitted by law, HoneAI and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, or business opportunities
• Loss or corruption of data
• Costs of substitute services
• Damages arising from AI-generated content you choose to use
• Damages arising from payment disputes between you and your clients

Our total liability to you shall not exceed the amount you paid to HoneAI in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless HoneAI and its operators from any claims, damages, losses, and expenses (including legal fees) arising from your use of the service, your violation of these Terms, or your violation of any third-party rights.

13. Termination

You may delete your account at any time through the app or by contacting support@honeai.app. We reserve the right to suspend or terminate your account for violation of these Terms, with or without notice.

Upon termination, your right to use HoneAI ceases immediately. We will delete your data in accordance with our Privacy Policy.

14. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via the app or email. Continued use of HoneAI after changes take effect constitutes acceptance of the revised Terms.

15. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, except that either party may seek injunctive relief in a court of competent jurisdiction.
